Rental Agreement Form & Policy
Rent A Camilla Site Policy
1.1 “Rental Period” means the period that the User booked the Camilla item for - starting from the day the Camilla is delivered to the User’s delivery address, to the day the last day of the hire period.
1.2 “Rental Price” (“price”) means the cost of the hire of the Camilla as agreed between Rent-A-Camilla and the customer.
1.3 “Rental Return Due Date” means the date the Camilla is expected to be back at Rent-A-Camilla warehouse. The Rental Return Due Date is calculated to be within 2 to 3 business days from the end of Rental Period, depending on the customers location.
2.1 Any instructions received by Rent-A-Camilla from the User for the hire of Apparel and/or the User’s acceptance of Apparel supplied on hire by Rent-A-Camilla shall constitute acceptance of the terms and conditions contained herein.
2.2 Where more than one User has entered into this agreement, the Users shall be jointly and severally liable for all payments of the Price.
2.3 Upon acceptance of these terms and conditions by the User the terms and conditions are irrevocable and can only be amended with the written consent of Rent-A-Camilla.
2.4 The User shall give Rent-A-Camilla not less than fourteen (14) days prior written notice of any proposed change in the User’s details (including but not limited to, changes in the User’s address, facsimile number, or business practice). If an item is lost due to incorrect user details, the user will be reliable for all costs.
2.5 The User accepts full liability for the hire item once it leaves the hands of Rent-A-Camilla.
2.6 Apparel is supplied by Rent-A-Camilla based only on the terms and conditions of hire.
3. Price & Payment
3.1 The Price shall be Rent-A-Camilla current Price.
3.2 Rent-A-Camilla has the right to change the price in the event of a variation to the User’s requirements.
3.3 At Rent-A-Camilla sole discretion:
(a) a deposit may be required.
(b) a rental agreement form must be signed allowing Rent-A-Camilla to charge the user for any damage, excess dry-cleaning or other costs.
(c) payment shall be due before delivery of the Apparel. (d) if the rental agreement is not signed nor a bond given the item is not posted for hire and the payment kept
3.4 Payment may only be made by credit card (only Amex, Mastercard and Visa accepted), PayPal or Afterpay. NO CASH!!
3.5 GST and other taxes and duties that may be applicable are expressly included in the Price.
3.6 All Prices on our website are denominated in Australian Dollars.
4. Rental Period & Late Fee's
4.1 Rental period shall commence from the date selected by the User on the Rent-A-Camilla Website.
4.2 Rental period ends on the date selected by th User on the Rent-A-Camilla Website. Where Apparel has not been returned to Rent-A-Camilla by the Rental Return Due Date then Rent-A-Camilla shall be entitled to charge additional hire fees until the Apparel is returned to Rent-A-Camilla and deduct such additional hire fees from the User’s credit card which was provided at the time of placement of the User’s order. Such additional charges shall be charged between $20-$40 for each day overdue, depending on the item.
4.3 When counting overdue days Rent-A-Camilla shall not count either Sundays or Public Holidays.
4.4 If the User pays Rent-A-Camilla an amount equal to 150% of the recommended retail value in late fees and the User still has the item(s) in their possession, the item(s) is The User’s to keep.
4.5 If the User has not returned the rental item(s) within 15 days after the return date, Rent-A-Camilla will consider the rental item(s) as non-returned and will charge the User’s credit card 150% of the recommended retail value (minus the rental and late fees that the User has already paid).
4.6 If the user returns the hire incorrectly a $40 fee will apply. This happens when the user puts the express bag in a red (regular post box) instead of a yellow (express box).
5.1 Rent-A-Camilla express posts apparel to nominated address for a charge of $25, if the address is outside of the express post notice must be given or Rent-A-Camilla is not responsible for late arrival of hire.
5.2 If the parcel does not arrive on time due to delays with Australia Post, Rent A Camilla is not at fault and does not have to provide a full refund. If a refund is provided a 50% Hire service fee will apply and no postage will be refunded.
5.3 if the parcel is lost or stolen in the process of postage the user is liable for payment or replacement.
6.1 Rent-A-Camilla retains property in the Apparel nonetheless all risk for the Apparel passes to the User on delivery.
6.2 The User accepts full responsibility for the safekeeping of the Apparel.
6.3 If the Apparel gets lost, stolen or damaged beyond repair, whether or not such loss, theft, or damage is attributable to any negligence, failure, or omission of the User then the User will be liable to pay for replacement of the item.
7. Title to Hired Camilla's
7.1 The Apparel is and will at all times remain the absolute property of Rent-A-Camilla. This includes copyright of all images.
7.2 As the copyright owner of all images Rent-A-Camilla has the right to reproduce the work, display the work publicly, prepare derivative works based on the copyrighted work; and distribute copies of the copyrighted work to the public by sale, rental or lending, and/or to display the image.
7.3 If the User fails to return the Apparel to Rent-A-Camilla may enter upon and into land and premises owned, occupied or used by the User, or any premises where the Apparel is situated and take possession of the Apparel.
8.1 The User shall inspect the Apparel on delivery and shall within 3 hours of receipt of the Apparel notify Rent-A-Camilla (by phone or email) of any alleged defect, shortage in quantity, damage, failure to comply with what was ordered.
9.1 If the User wishes to cancel an order, then they must contact Rent-A-Camilla and A 50% cancellation fee will apply. A full refund less the cancellation fee upon will be issued.
9.2. If the User cancels an order paid with Afterpay the refund will be issued via after-pay and may take 24-48 hours to appear back in your account.
9.3 It is the Users obligation to order the correct size as full refunds will not be granted due to wrong size or change or mind. All Apparel which is to be returned because of incorrect sizing or because the User has changed their mind must be sent back same day of signing for the delivery. No refund will be given.
10. Default and Consequences of Default
10.1 If the User owes RentACamilla any money the User shall indemnify Rent-A-Camilla from and against all costs and disbursements incurred in recovering the debt (including but not limited to internal administration fees, legal costs on a solicitor and own client basis, collection agency costs, and bank dishonour fees).
11. Damage Charges
We ask that you do not use Hollywood tape as it rips the silk when removed. If you do use tape please be very careful as we will have to charge for the damage. Any damages seen upon return will be texted or emailed to the user within 3 hours and the user will pay damages.
Please note the information you provide below will only be used if item is damaged (includes but not limited to; tears, stains, marks and or other damage that renders the Camilla not rentable), lost or stolen.
12. Ex-Hire Stock Purchases
12.1 If the User has a problem with their purchase they must contact rentacamilla within 24 hours of parcel acceptance, otherwise no refund will be accepted.
12.2. The User accepts the conditions that Ex hire stock is sold AS IS, the condition is used and suffers from general wear and tear unless stated otherwise. No refunds nor exchanges are accepted for items labelled "ex-hire stock".
